The prayer of the petitioner in this Writ Petition is as under: "... to issue writ, order direction more particularly in the nature of writ of Mandamus declaring the inaction of respondent Nos.3 and 4 in granting / sanction of the building permit as per norms based on the application of the Petitioner dt 13.03.2019 for construction of compound wall and dwelling unit in plot No.44, Block-H, Sector 3 of East City Project situated in Bibinagar village and Mandal, YadadriBhuvanagiri district as illegal, arbitrary and violative of Articles 14, 21 and 300 A of Constitution of India and consequently, to issue directions to respondent Nos.3 and 4 herein to grant / sanction building permission according to norms to the Petitioner based on the application dt 13.03.
2019 and to pass such other order or orders as this Hon'ble Court deem fit and proper in the interest of justice." Learned counsel for the petitioner submits that earlier, the petitioner submitted an application to the Hyderabad Metropolitan Development Authority (HMDA) on 18.01.2019 for grant of building permission in respect of the subject sites and the HMDA has directed the petitioner to file an application before the Gram Pancahayat concerned and accordingly, the petitioner made an application to the respondent Gram Pancahayat on 13.03.2019 for grant of building permission. As no orders are passed so far, the present Writ Petition is filed.
Heard the learned counsel for the petitioner and Sri G.Narender Reddy, learned Standing Counsel for the respondent Gram Pancahayat.
Sri G.Narender Reddy, learned Standing Counsel, would submit that no application as alleged by the petitioner was received in the office of the respondent Gram Pancahayat and if the petitioner
submits a fresh application, the same will be considered and appropriate orders will be passed in accordance with law. In view of the above, the Writ Petition is disposed of granting liberty to the petitioner to make a fresh application to the respondent Gram Panchayat for grant of building permission in the subject lands. On receipt of such application, the respondent Gram Panchayat shall consider the same and pass appropriate orders in accordance with law within period of two weeks therefrom.
As a sequel, Miscellaneous Petitions pending, if any, shall stand closed.
