THE HON'BLE SRI JUSTICE S.V.BHATT W.P. No.20109 of 2018 ORDER:

At the request of learned Assistant Government Pleader, on 18.06.2018, this writ petition is directed to be listed today.

The Assistant Government Pleader referring to written instructions dated 18.06.2018 submits that the subject notice is issued under WALTA 2002. The 3rd respondent is enquiring into the legality of digging the bore well and continuing to run the same. He fairly states that the instructions are silent on the seizure complained in the writ petition.

Therefore, the writ petition is disposed of by directing the 3rd respondent to remove the seizure, if the seizure is effected and alternatively, the 3rd respondent is directed to effect the seizure of bore well only in accordance with law and after communicating the orders to petitioner and the contesting parties. No order as to costs.

Miscellaneous petitions, if any, pending, shall stand closed.
