HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION NO. 2535 OF 2017 ORDER:

Even after receipt of notice, respondents 4 & 5 did not appear. Heard learned counsel appearing for petitioner and learned Government Pleader appearing for respondents 1 to 3. Petitioner states that respondents 4 & 5 are his neighbors. When they tried to remove the windows on the southern side wall house, he filed O.S.No. 541 of 2016 on the file of III Additional Junior Civil Judge, Ongole, against them for permanent injunction. It is stated that the learned III Additional Junior Civil Judge, Ongole, in I.A.No. 479/2016, granted injunction order after contest. When respondents 4 & 5 interfered with the property of the petitioner even though the injunction order is in subsistence, a complaint was lodged and the same was registered as Crime No. 27 of 2017 on 17.1.2017. The grievance of the petitioner is that even after the registration of the crime and an injunction order is in subsistence, the police are not affording protection to the petitioner and not conducting the investigation.

In view of the grievance of the petitioner, this Writ Petition is disposed of directing the third respondent to continue the investigation in respect of the Crime No. 27/2017 registered on 17.1.2017 and whenever the petitioner approaches the third

respondent with regard to the threat to his person or property, necessary protection shall be afforded to him. There shall be no order as to costs. As sequel thereto, Miscellaneous Petitions, pending if any, shall stand closed.
