HON'BLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.6854 of 2019 ORDER :

Petitioner, who is A1 in Cr.No.160 of 2017 on the file of the S.H.O. Zaffargadh Police Station, Warangal District, registered for the offences punishable under Sections 120 (b), 302, 364, and 326 r/w 34 IPC, filed this petition under Sections 437 and 439 Cr.P.C. seeking regular bail. 2.

Heard learned counsel for the petitioner/A1 and the learned Additional Public Prosecutor appearing for the respondent State.

Learned counsel for the petitioner/A1 submits that in this case entire investigation is completed and charge sheet is also filed before the trial Court and the same was numbered as S.C.No.243 of 2018. He further submits that the petitioner is suffering from Kidney problem and he is in custody from 02.12.2017. He further submits that the petitioner is the only earning member of his family and if he is not released on bail, his entire family will be put to great hardship and hence, he prays to grant bail to the petitioner.

On the other hand, the learned Additional Public Prosecutor representing the State vehemently opposed the bail application by contending that in this case trial has already been commenced and almost 14 witnesses have already been examined and the mater is posted for further

evidence on 11.11.2019 and hence, the petitioner is not entitled for bail.

As seen from the record, it is clear that this is 4th bail application filed by the petitioner. The earlier three bail application filed by the petitioner were dismissed on merits by this Court vide orders, dated 12.10.2018, 15.11.2018 and 09.07.2019 in Crl.P.Nos.10600 of 2018, 11880 of 2018 and 2712 of 2019 respectively. No new grounds whatsoever have been assigned by the petitioner in the present bail application. Hence, I am not inclined to grant bail to the petitioner.

Accordingly, the Criminal Petition is dismissed. However, the trial Court is directed to conclude the trial in S.C.No.243 of 2018 as expeditiously as possible, preferably within a period of two months from the date of receipt of a copy of this order.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
