THE HON'BLE SRI JUSTICE A.VENKATESHWARA REDDY CIVIL MISCELLANEOUS APPEAL No.366 of 2009 JUDGMENT:

Heard learned counsel on both sides. It is represented by the learned counsel for the appellants and the appellants as party in person that their earlier counsel Mr.M.S.R.Subrahmanyam passed away and accordingly they have engaged the services of Sri.V. Harish Kumar. Parties have filed a compromise petition under Order XXIII Rule 3 C.P.C. The terms of compromise are read over and explained to the parties and admitted that they are true and correctly recorded. 2.

As per the terms of compromise, the respondent No.1 has agreed to receive Rs.7 Lakhs towards full and final settlement of the entire claim, pursuant to the award in case No.29/3/3/053 of Andhra Pradesh Industry Facilitation Council at HYDERABAD covered by CMA No.366 of 2009 pending on the file of this Court arising out of Arbitration O.P.No.836 of 2004 dated 08-12-2008 on the file of learned II Additional District Judge, Ranga Reddy.

While recording the above fact, in terms of compromise, this Civil Miscellaneous Appeal is disposed of by setting aside the award passed in A.O.P. No.836 of 2004.

Miscellaneous applications, if any pending, shall stands closed. In the circumstances of the case, there shall be no order as to the costs.
