THE HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No.20196 OF 2018 ORDER:

The petitioner, at the first instance, after receiving the notice impugned in the Writ Petition, has filed petition with a prayer to reject the case No.B/128/2018 and since no order is passed on the said request, now, has filed the instant Writ Petition, challenging the notice impugned in the Writ Petition as completely without jurisdiction. This Court prefers to direct the 3rd respondent to take up the objection filed by petitioner and dispose of as expeditiously as possible, preferably within four weeks from the date of receipt of copy of this order and thereafter if a conclusion is recorded that respondent No. 3 has jurisdiction to proceed further in the matter, he is given liberty to proceed further subject to the right of petitioner raising objections on merits of the matter. 2.

The petitioner is given liberty to file memo by enclosing a copy of this order for disposing of the prayer made by petitioner, within the time stipulated by the Court.
