HON'BLE SRI JUSTICE A.RAJASHEKER REDDY Tr.C.M.P.No.332 of 2014 ORDER:

This petition is filed to withdraw the F.C.O.P.No.120 of 2014 from the file of Family Court, Guntur and transfer the same to Family Court, Huzurnagar, Nalgonda District.

The case of the petitioner is that the marriage of the petitioner was performed with the respondent on 14-06-1998 at Tirumala Tirupati Devasthanams, Tirumala according to Hindu rites. After the marriage, both of them lived at Guntur and they were blessed with two male children. Due to harassment of the respondent, the petitioner left the house and residing with their parents at Kapugallu village, Kodad Mandal, Nalgonda District. Now, the respondent filed F.C.O.P.120 of 2014 under Section 9 of Hindu Marriage Act at Family Court, Guntur and the petitioner is unable to attend the Court at Guntur as she has no male assistance and had no income. Hence, the Transfer CMP is filed.

Though notice is served on the respondent, no counter is filed and no appearance on behalf of the respondent.

In view of the assertions made by the petitioner that she is unable to attend the Court at Guntur due to lack of income and male assistance, I deem it proper to withdraw FCOP.No.120 of 2014 pending on the family Court Guntur and transfer the same to Senior Civil Judge's Court, Huzurnagar, Nalgonda District.

Accordingly, the Transfer CMP is allowed. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
