THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION NOs.8910 AND 8914 OF 2017 COMMON ORDER:

Since the relief sought for in both the writ petitions is one and the same, these writ petitions are being taken up and disposed of by way of this common order.

The petitioners claim that they are the absolute owners of the land in an extent of Ac.0.38 gts in Sy.No.896/AA situated at Edulla Bayyaram village, Pinapaka Mandal, Khammam District and an extent of Ac.6.20 gts of land in Sy.No.437/27 situated at Nacharam village, Enkoor Mandal, Khammam District, respectively. It appears that the 3rd respondent took up enquiry against the 5th respondent under Andhra Pradesh Scheduled Areas Land Transfer Regulations Act, 1969 and dropped the proceedings in the year 2006. The appeal was also dismissed. However, while dismissing the appeal, it was observed by the 2nd respondent that since the respondent failed to prove possession, the concerned Tahsildars are directed to take over the suit schedule land into Government custody evicting the person whoever is in possession and assign the same to the eligible poor tribals. Challenging the said orders, the petitioners preferred revisions before the 1st respondent along with applications for stay. When the same were not considered for the last four months, the present writ petitions are filed. 3.

In view of pendency of revisions before the 1st respondent, this Court is not inclined to entertain the writ petitions and give a finding on merits. However, the 4th respondent shall not take any steps for eviction of the petitioners pursuant to the orders passed by the 2nd respondent till the disposal of the revisions by the 1st respondent. It is needless to observe that the 1st respondent shall dispose of the revisions by giving due opportunity to the petitioners as wells as to the unofficial respondents as expeditiously as possible, but not later than six months from the date of receipt of a copy of this order.

Accordingly, the writ petitions are disposed of. No order as to costs. Miscellaneous petitions, if any, pending in these writ petitions shall stand closed.
