THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 8495 of 2023 ORDER:
This Criminal Petition is filed under Section 438 of Cr.P.C. by petitioner/A1 seeking bail in the event of her arrest in connection with FIR No.392 of 2023 on the file of Osmania University Police Station, Hyderabad, registered for the offences punishable under Section 370, 370(A)(2) of Indian Penal Code and Section 3, 4, & 5 of PIT Act. 2.
Heard learned counsel for the petitioners and learned Assistant Public Prosecutor for the respondent-State and perused the record. 3.
It is alleged that the police raided the premises i.e., D.No.1-484/NR, Bindawan Nagar, Street No.8, Habsiguda, Hyderabad and found four females who were indulging in prostitution. Customers were also found in the said premises. The women and the customers were also examined during raid. It is alleged that the petitioner/A1 is the person who is running the beauty parlor and under the garb of running the beauty parlor, she was keeping female sex workers in the beauty parlor. 4.
Learned counsel for the petitioner would submit that petitioner was falsely implicated in the Crime and according to the police she was also not present when the police raided the premises. 5.
As seen from the complaint, all the women are majors and three of them are married women and fourth one is of the age 24. Keeping in
view, the petitioner/A1 is not involved in similar crime, petitioner/A1 can be granted the relief of Anticipatory Bail. 6.
Accordingly, the Criminal Petition is allowed and the petitioner/A1 shall be enlarged on bail subject to the following conditions:
1) The petitioner/A1 is directed to surrender before the Station House Officer, Osmania University Police, Hyderabad, Hyderabad, on or before 14.09.2023. On such surrender, the said Station House Officer shall release the petitioner/A1 on bail, on their executing personal bonds for a sum of Rs.50,000/- (Rupees Fifty Thousand only) each with two sureties for a like sum each to his satisfaction.
2) On such release, the petitioner/A1 shall appear before the police on every Monday between 10.00 a.m. to 1.00 p.m. for a period of eight weeks, for the purpose of investigation.
3) The petitioner/A1 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
