THE HONOURABLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.24116 of 2015 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:

"to issue Writ of Mandamus declaring the action of 2nd respondent in issuing impugned notice No.NOC/Acct. Notice/1/2015 dated 23.07.2015 as arbitrary and illegal." The President, Officers Club, Nizamabad issued the impugned notice No.NOC/Acct./Notice/1/2015, dated 23.07.2015 calling upon the petitioner to show-cause as to why action should not be taken against him for misappropriation of funds to a tune of Rs.30,000/-. It is submitted by the learned counsel for the petitioner that the petitioner would respond to the said notice dated 23.07.2015 by way of explanation and the same may be directed to be considered in accordance with law.

In view of the above, this Writ Petition is disposed of permitting the petitioner to submit explanation to the show-cause notice dated 23.07.2015 within a period of one week from the date of receipt of a copy of this order. If any such explanation is submitted, the same shall be considered and appropriate orders be passed by the District Collector in accordance with law after giving notice and opportunity of being heard to the petitioner. No costs.

As a sequel, the miscellaneous applications, if any, shall stand closed.
