Heard learned counsel for the petitioner and learned Special Standing Counsel.

According to petitioner there is vacancy in Nulakajodu Gram Panchayat, Bhamini Mandal, Srikakulam District. Having come to know about the existing vacancy, petitioner made an application to the Mandal Parishad Development Officer to consider him for appointment in the existing vacancy. This application was placed before the Janmabhoomi Mavooru Committee. According to petitioner, the Committee has recommended the name of petitioner for such appointment.

Alleging inaction on the said recommendation, this writ petition is filed.

Written instructions are furnished to learned Special Standing Counsel by the Project Director, District Water Management Agency, Srikakulam, a copy of which is placed before this Court. A reading of the instructions would disclose that as per the procedure, the Gram panchayat Janmabhoomi Mavooru Committee would submit list of three candidates to the MPDO concerned. The MPDO in turn should process and recommend one candidate to the Project Director. While so, concerning this village, the MPDO, recommended five names. However, the Project Director seems to have processed five names recommended and found that three are not eligible for appointment as per the norms and only two are eligible including the petitioner herein. However, so far he has not taken any decision.

Having regard to the instructions furnished to learned Special Standing Counsel, the Writ Petition is disposed of directing the Project Director to examine the suitability of two candidates by following the norms of recruitment and if found suitable select one of them for appointment as Senior Mate of Nulakajodu Gram Panchayat, Bhamini Mandal, Srikakulam District. The entire exercise shall be completed and appropriate decision be made as expeditiously as possible, preferably within a period of six (6) weeks from the date of receipt of copy of this order.
