Heard both sides.

In continuation to the interim order of this Court dated 04.08.2017 of stay of arrest for six weeks, leave about the submission of the learned counsel for the respondents of proof will be filed during investigation regarding the complaint given to the police on the same day of occurrence with no action. So far as the attracting of the penal consequence of Section 3(1)(r) & (s) of SC & ST (POA) amended Act, from there is force in the contention of there is no public view to attract the penal provision the interim order is extended pending investigation not to arrest, however investigation shall go on.

Accordingly and in the result, the Criminal Petition is disposed of.
