THE HON'BLE SRI JUSTICE NOOTY RAMAMOHANA RAO WRIT PETITION NO. 39187 OF 2014 ORDER:

None appears for the petitioner.

The petitioner is working as an Assistant Engineer with the Rural Water Supply and Sanitation Engineering Department of the Government of Andhra Pradesh. The Superintendent Engineer, Kakinada by his proceedings dated 05.12.2014 deputed the petitioner to work on Other Duty Basis at Chinturu and he was also kept as Full Additional Charge of the RWS&S Section at Nellipaka under the control of the Rampachodavaram Sub Division until further orders are passed. These orders of the Superintendent Engineer are challenged in this writ petition. The petitioner being a civil servant of the State of Andhra Pradesh, could not have approached this Court at the first instance in view of the Judgment rendered by the Supreme Court in L. Chandra Kumar v. Union of India[1]. Hence, for this reason alone, this writ petition is dismissed.

Consequently, miscellaneous applications pending shall also stand dismissed. No costs.
