THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.6500 OF 2016 ORDER:

This petition is filed by the petitioners-A1 to A4 under Section 482 Cr.P.C. seeking to quash the proceedings against them in S.C.No.128 of 2016 on the file of the VII Assistant Sessions Judge, Ranga Reddy District at L.B. Nagar.

Heard and perused the material available on record. The petitioners are alleged to have committed the offence punishable under Section 306 IPC. The marriage of the deceased was performed with L.W.4-Ravindra Babu. A1 and A2 are the in-laws of the deceased; A3 is the brother of L.W.4 and A4 is the wife of A3. It is alleged that due to harassment of the petitioners, the deceased committed suicide.

Learned Counsel for the petitioners submitted that A1 was not present at the time of incident and that A1 and A2 are suffering from old-age ailments and that A3 and A4 are Government employees and that there are disputes over the properties belonging to A1 and the present complaint has arisen out of such disputes and that the petitioners never committed the alleged offence. Considering the facts and circumstances of the case, this Court is not inclined to interfere with the proceedings in the above crime. However, the petitioners are at liberty file discharge application before the trial Court. On such application being filed, the trial Court is directed to consider the same in accordance with law. Till such time, the presence of the petitioners before the trial Court is dispensed with. Accordingly, the Criminal Petition is disposed of. Consequently, miscellaneous petitions pending, if any, shall stand closed.
