THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.38622 of 2015 ORDER:
The grievance of the petitioners was that the Additional Agent to Government (Project Officer, ITDA), Utnoor, Adilabad District, the 3rd respondent, did not grant an interim order in relation to the operation of the order dated 18.10.2015 passed by the Special Deputy Collector (Tribal Welfare), Utnoor, Adilabad District, which was under appeal before him.
This Court adjourned the matter to enable the learned Assistant Government Pleader to get instructions and in the meanwhile directed status quo to be maintained.
Learned Assistant Government Pleader for Social Welfare placed before this Court a copy of the letter dated 01.12.2015 furnished by the Additional Agent to Government, Project Officer, ITDA, Utnoor, Adilabad District, wherein he stated that the petitioners' appeal was received by his office on 10.11.2015 and was numbered as A4/604/2015. The case was stated to be under examination and the date of hearing would be communicated in due course to both parties. As the appellate authority is seized of the matter, this Court deems it unnecessary to adjudicate this writ petition on merits as it is for the appellate authority to apply its mind and take an appropriate decision in the appeal as regards the validity of the order dated 18.10.2015, which is under appeal before it. Sri R.Narasimha Reddy, learned counsel for the petitioners, stated that the stay application filed in the said appeal would require to be disposed of in the first instance.
In that view of the matter, the 3rd respondent is directed to give priority to the interlocutory application filed by the petitioners in the appeal and dispose of the same in accordance with law after giving due opportunity of hearing to both parties. This exercise shall be completed expeditiously and in any event not later than four weeks from the date of receipt of a copy of this order. Pending this exercise, status quo as directed by this Court shall be maintained by the authorities.
The writ petition is disposed of with the above directions. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
