HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 9839 of 2016 O R D E R:- Heard learned counsel for the petitioner and learned Government Pleader for Civil Supplies appearing for the respondents.
This writ petition, under Article 226 of the Constitution of India, is filed seeking a mandamus to declare the suspension orders issued by the 3rd respondent as illegal and arbitrary. Briefly, the facts of the case are that the petitioner was appointed as Dealer of Fair Price Shop No.35 of Utakallu Village, Gooty Mandal, Ananathapuram District. While so, basing on the report of the 4th respondent dated 27.12.2015 that the petitioner committed certain irregularities in distribution of essential commodities, the 3rd respondent issued a show cause notice dated 28.12.2015 calling upon the petitioner to show cause as to why his authorization should not be cancelled, for which the petitioner submitted explanation on 08.01.2016. Not satisfied with the explanation of the petitioner, the 3rd respondent suspended his authorization vide proceedings Rc.DICS/3376/2015 dated 13.01.2016. Challenging the same, the petitioner preferred an appeal before the 2nd respondent and the same was disposed of on 06.02.2016.
The 2nd respondent while remanding the matter to the 3rd respondent directed him to
pass appropriate orders in the matter within three weeks. The main grievance of the petitioner is that though the 2nd respondent directed the 3rd respondent to complete the enquiry within three weeks, the 3rd respondent has not completed the enquiry so far.
Inasmuch as the 2nd respondent appellate authority directed the 3rd respondent to complete the enquiry, the 3rd respondent is directed to comply with the order of the 2nd respondent dated 06.02.2016 and pass appropriate orders, within ten (10) days from the date of receipt of a copy of this order.
With the above direction, the Writ Petition is disposed of. There shall be no order as to costs.
Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand closed.
