THE HON'BLE SRI JUSTICE T.AMARNATH GOUD WRIT PETITION NO.13500 OF 2005 ORDER:

This writ petition is filed seeking to declare the order of attachment passed by the 1st respondent dated 6-6-2005 made in No.AP/SRO/GNT/40331/Comp-III/PRM/2005/248 as illegal, arbitrary and without jurisdiction.

It is the case of the petitioner that the first respondent issued proceedings dated 6-6-2005 for attachment of the movable properties of the petitioner educational institution without determining the amounts payable by the petitioner and without giving reasonable opportunity.

It is contended by the learned counsel appearing on behalf of the petitioner that attachment order has been passed without determining the amounts payable by the petitioner institution and without giving reasonable opportunity for payment of amounts by it.

In view of the above circumstances, the writ petition is disposed of setting aside the impugned attachment order dated 6-6-2005 passed by the first respondent in No.AP/SRO/GNT/40331/Comp-III/PRM/2005/248. However, liberty is given to the respondent to proceed afresh as per law after according reasonable opportunity to the petitioner and

after determining the amounts payable by the said institution. No order as to costs. As a sequel, the miscellaneous petitions pending if any shall stand closed.
