HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.22310 OF 2017 O R D E R :

The case of the petitioner is that she filed appeal before the 2nd respondent under Rule 35 of the A.P.Minor Mineral Concession Rules, 1966, along with stay petition, against the demand notice dated 05.05.2017 issued by the 3rd respondent. As no orders are passed on the same, present writ petition is filed. Heard learned counsel for the petitioner and learned Government Pleader for Mines and Geology.

Since the statutory appeal filed by the petitioner is pending before the 2nd respondent, the 2nd respondent is directed to dispose of the stay petition filed by the petitioner in the said appeal, within a period of two weeks. Till disposal of the said application, there shall be stay of demand notice dated 05.05.2017 issued by the 3rd respondent.

Accordingly, the writ petition is disposed of. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
