The present writ petition is filed to declare the action of the respondent No.3 in not investigating into the crime registered as Cr.No.54 of 2019 dated 08.02.2019.

Heard learned counsel for the petitioner and the learned Assistant Government Pleader for Home.

The learned Assistant Government Pleader for Home, on written instructions dated 30.10.2019, which is placed on the record of this Court, would submit that on receipt of a complaint from the petitioner, a case was registered in Cr.No.54 of 2019 for the offence under Section 420 of the Indian Penal Code of Godavarikhani I Town Police Station on 08.02.2019 and the case is under investigation. In the course of investigation, witnesses were examined and their statements were recorded. Thereafter, the Investigating Officer has addressed a letter to the Tahsildar, Ramagundam on 16.04.2019 with a request to conduct survey of the land in Sy.Nos.729 and 728/ B and demarcate the boundaries. Thereafter, he addressed a letter to Revenue Divisional Officer, Peddapalli on 14.10.2019 with a request to conduct survey of the land in Sy.Nos.
729 and 728/ B and demarcate the boundaries. That apart, the Investigating Officer also addressed a letter to the Tahsildar, Ramagundam on 25.10.2019 to furnish report regarding mutation of the land in Sy.Nos.729 and 728/ B and a reply from the revenue authorities is awaited. It is stated that after obtaining reply from the revenue authorities, the case will be finalized.

Having regard to the factual position, as detailed in the written instructions, which reflects that the investigation is under progress in the crime registered on the complaint of the petitioner and that the case would be finalized, no further orders are required to be passed in this writ petition.
Accordingly, the writ petition is closed. Pending miscellaneous petitions shall also stand closed. There shall be no order as to costs. ________________ T. VINOD KUMAR, J November 8, 2019 DSK
