HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.20062 OF 2018 O R D E R :

This writ petition is filed challenging the action of the respondents in not allowing the petitioners to operate and ply their water tankers between 8.00 a.m to 12.30 p.m and 3.30 p.m. to 9.00 p.m. of every day on the public roads of Kurnool City limits to supply water to the residents of the Kurnool City, as illegal and arbitrary.

Learned counsel for the petitioners submits that the rights of the petitioners under Article 14, 19 and 21 of the Constitution of India are being violated; and that customers of the petitioners are suffering without water because of the restrictions imposed on the petitioners by the respondents for supply of water to their customers.

Learned Government Pleader for Home on instructions submits that due to heavy traffic, they have regulated the traffic and imposed restrictions and that they have not totally prohibited the petitioners from carrying their activity, but only imposed certain restrictions on the petitioners only to regulate the heavy traffic in peak hours, after giving notices of its stake-holders and after considering the objections.

Having regard to the aforesaid facts and circumstances, it is the duty of the competent authority to regulate the traffic and for

that purpose they can impose certain restrictions. If petitioners are aggrieved they can make representations to the 4th respondent and on such representations being made, it is for the 4th respondent to consider the same and pass orders, in accordance with law. With the above direction, the writ petition is disposed of. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
