THE HON' BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.23279 of 2019 ORDER:

The petitioner alleges that the 5th respondent, with an intention to encroach petitioner's property, had included the property of the petitioner in his building permission application while obtaining building permission. It is the specific case of the petitioner that even before the sanction was granted in favour of the 5th respondent, the petitioner had cautioned the respondent authorities with respect to the attempts of the 5th respondent to encroach the petitioner's property, however, ignoring all the representations submitted by the petitioner, building permission was granted in favour of 5th respondent. The petitioner asserts that he submitted detailed representations on 27.08.2019 and 11.09.2019, but same were not considered while granting building permission in favour of 5th respondent.

Heard learned counsel for the petitioner, and the learned Government Pleader for Municipal Administration and Urban Development. Inasmuch as the respondent authorities are duty bound to consider representations in terms of Section 450 of the GHMC Act, the writ petition is disposed of with a direction to respondents 2 to 4 to consider the representations dated 27.08.2019 and 11.09.2019 submitted by the petitioner and pass appropriate orders thereon, within a period of three weeks from the date of receipt of a copy of this order, after giving opportunity of hearing to the petitioner as well as 5th respondent. No costs. Miscellaneous petitions, if any pending, shall stand closed.
