THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SMT JUSTICE T.RAJANI Writ Appeal No.786 of 2017 JUDGMENT: (Per the Hon'ble the Acting Chief Justice Ramesh Ranganathan) After arguing for some time, all the learned counsel appearing in the matter are in agreement that, instead of adjudicating the appeal on merits, the Learned Single Judge may be requested to dispose of the vacate stay petition filed by the appellant at an early date.
Sri U.Muralidhar Rao, learned counsel for the respondent-writ petitioner, would submit that, while posting the matter to 22.06.2017, the Learned Single Judge had granted an interim order in the meanwhile; the petitioner has filed an application seeking extension of the interim order; the appellant has served a copy of the vacate stay petition on them; and, as the matter is slated for hearing on 22.06.2017 i.e tomorrow, no interference is called for in an intra-court appeal under Clause 15 of the Letters Patent. While it would be wholly inappropriate for us to decide the board of the Learned Single Judge, we are satisfied that this matter needs to be heard with utmost expedition, as any delay in hearing the matter would not only cause substantial prejudice to the appellant but may also be against larger public interest. We have no reason to doubt that the writ petition would be taken up on 22.06.2017, as indicated in the order in W.P.No.18468 of 2017 dated 08.06.2017, failing which either of the parties may request the Learned Single Judge to take up the matter out of turn.
Subject to the aforesaid observations, the Writ Appeal fails and is, accordingly, dismissed. Miscellaneous Petitions pending, if any, shall also stand dismissed.
