THE HON'BLE Dr. JUSTICE SHAMEEM AKTHER Criminal Petition No.6337 of 2018 ORDER:

This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973 (for short, 'Cr.P.C'), is filed by the petitioners/accused Nos.1 to 6, for grant of anticipatory bail in the event of their arrest in Crime No.70 of 2018 of Pebbair Police Station, Wanaparthy District, registered for the offences punishable under Sections 427, 448 and 324 read with 34 IPC.

Heard the learned counsel for the petitioners/accused Nos.1 to 6, learned Additional Public Prosecutor representing the respondent-State and perused the record.

At the time of hearing, learned counsel for the petitioners/accused Nos.1 to 6 fairly submits that typographical mistakes occurred in the affidavit filed in support of the petition and he seeks permission of the Court to correct the same. 4.

The request of the petitioner cannot be accepted since there is no provision under the Code of Criminal Procedure to correct the mistakes occurred in the affidavit.

Accordingly, the Criminal Petition is dismissed granting liberty to the petitioner/accused to file a fresh petition. Miscellaneous petitions, if any, pending in this Criminal Petition, shall stand closed.
