THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 6537 of 2022 ORDER:

This Criminal Petition is filed under Section 437 & 439 of the Code of Criminal Procedure,' 1973 (for short "Cr.P.C.") seeking regular bail to the petitioner/Accused No.2 in Crime No.186 of 2021 on the file of Madannapet Police Station, Santhosh Nagar, Hyderabad, registered for the offence punishable under Section 392 IPC. 2.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record. 3.

The case against the petitioner is that on 24.11.2001, he is alleged to have snatched Samsung phone from the de facto complainant by wearing a mask. The alleged person seizing the phone was identified as this petitioner and the petitioner was remanded to custody on 23.06.2022.

Learned counsel for the petitioner submits that due to differences between the de facto complainant and the petitioner, the present false complaint is filed. He further submits that there are no other criminal antecedents as far as the petitioner is concerned. 5.

The said aspect is not disputed by the learned Assistant Public Prosecutor.

In the circumstances, this Court is of the opinion that the petitioner/Accused No.2 can be granted bail subject to the following conditions.

i. The petitioner/Accused No.2 is directed to be released on bail on executing personal bond for a sum of Rs.20,000/- (Rupees Twenty thousand only) with two sureties for a like sum each to the satisfaction of VII Additional Chief Metropolitan Magistrate at Nampally, Hyderabad. ii. On such release, the petitioner/Accused No.2 shall appear before the concerned Station House Officer on every Monday between 10.30 a.m. and 01.00 p.m. for a period of eight weeks, for the purpose of investigation.

iii. The Petitioner/Accused No.2 shall abide by the other conditions stipulated in Section 437 (3) of Cr.P.C. 7.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
