This petition is filed for a writ of Mandamus seeking a direction to the respondents to consider the representation submitted by the petitioner dated 16.11.2014 along with SSC

certificate No.A067376, wherein the date of birth is recorded as 05.08.1965 and accordingly alter the date of birth from 27.01.1961 to 05.08.1965 in all company records including EPR etc. The case of the petitioner is that he was selected as Floating Badil Filler on piece-rate basis by the respondent Company vide proceedings dated 27.06.1996 and thereafter he was given full time employment in the respondent company in the year 2000. At the time of selection the petitioner produced SSC certificate issued by the Board of Secondary Education wherein the date of birth of the petitioner is clearly recorded as 05.08.1965 and the Colliery Manager also issued a date of birth certificate showing the petitioner's date of birth as 05.08.1965.

While so, recently, during routine verification of service record and medical examination, the company website generated a letter/circular dated 08.11.2014, wherein the petitioner's date of birth is recorded as 27.06.1961 instead of 05.08.1965. Immediately, the petitioner submitted his representation on 16.11.2014, but no orders are passed on the same, till today. Aggrieved by the same, present writ petition is filed.

Heard learned counsel for the petitioner and Sri J.Sreenivasa Rao, learned Standing Counsel for Singareni Collieries.

Since the petitioner has already submitted representation before the respondents which is pending, the 1st respondent is directed to consider and dispose of the representation of the petitioner dated 16.11.2014, in accordance with company rules and regulations and as per law, within a period of eight weeks from the date of receipt of a copy of this order.

Accordingly, the writ petition is disposed of. No order as to costs.
