ORDER

This petition under Section 482 Cr.P.C. is filed by the petitioner/A1 seeking to quash the proceedings in Cr.No.95 of 2016 of Khammam I Town Police Station, Khammam District, registered for the offence punishable under Section 420 IPC, against him.

2. It is alleged in the complaint that A1, who was a mediator for registration of a plot by A2 in favour of the de facto complainant, took an amount of Rs.11 lakhs from the de facto complainant from time to time for the purpose of registration and thereafter, both the accused were absconding, thereby cheated him. Based on the complaint, the aforesaid crime was registered against the accused.

3. As per the complaint, the matter arising out of civil dispute and the prime allegations are against the petitioner/A1. Truth or otherwise of the allegations made in the complaint can be ascertained by the investigating agency during the course of investigation. Therefore, this Court is not inclined to interfere with the impugned proceedings. However, the petitioner/A1 is at liberty to approach this Court after filing of the charge sheet, if any.

4. With the above direction, the Criminal Petition is disposed of. Miscellaneous petitions, if any, pending in this petition shall stand closed.
