Heard Mr.S.Syam Sunder Rao for petitioner.

The petitioner prays for the following relief: "..to issue a writ order or direction more particularly in the nature of writ of Mandamus to directing the 1st Respondent to frame necessary rules and regulations and standards governing the manufacturing and marketing of the flavoured water by the petitioner and consequently issue directions to the 2nd respondent not to harass the members of the petitioner in manufacturing and marketing the flavoured drinking water.."

Learned counsel for the petitioner could not convince the Court that there is cause of action or that the relief is in anticipatory in nature. In my considered view the prayer as prayed for cannot be considered and the writ petition must fail.

It is needless to observe that if the respondents herein either stop or interdict the ongoing activity at Datta Sai Industries, Bhasker Centre, Chilakaluripet, Guntur District and such interdiction is found to be without authority or arbitrary, then the petitioner get cause of action and can assail such action. By granting leave in such eventuality, the writ petition is disposed of. No order as to costs. Miscellaneous petitions pending if any shall stand closed. ______________ S.V.
