Notice under Rule 3 (Form -II) of the Rules 2007 made under the Andhra Pradesh Assigned Lands (Prohibition of Transfers) Act, 1977, was issued alleging violation of conditions of assignment granted of the land to an extent of Ac.1-03 cents in Sy.No.228/9 of Jangareddygudem Village and Mandal, West Godavari District. This notice was generated on 14.07.2017. Petitioner claims that in response, petitioners appeared and submitted the documents. Alleging that even before a decision is made, petitioner is sought to be dispossessed, this writ petition is filed. 3.

No material is brought on record to show that petitioner made her appearance on the date fixed and submitted her explanation. No material is shown that petitioner is sought to be evicted, even before appropriate final decision is taken. 4.

However, in order to balance the rival claims Court is inclined to dispose of the writ petition directing the Tahsildar, Jangareddygudem Mandal, Jangareddygudem, to pass orders, as warranted by law, in pursuant to the notice issued in Form-II, if not already passed and communicate the decision to the petitioner. If so far no order is passed and petitioner is not dispossessed, till the orders are passed, petitioner should not be dispossessed. There shall be no order as to costs.

- 3 - Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
