Heard learned Government Pleader for Municipal Administration and Rural Development for respondent Nos.1 and 2. The petitioner, in the instant writ petition, seeks the following prayer:
"For the reasons stated in the accompanying affidavit, it is therefore prayed that the Hon'ble Court may be pleased to issue a writ, order or direction more particularly one in the nature of a writ of mandamus by declaring the action of respondent No.3 in issuing proceedings in Lr.Roc.No.53/05/G1, dated 16.07.2005 sending proposals to the first respondent for conversion of park area into a press club by allotting the same as arbitrary, illegal, contrary to the sanctioned plan approved by the competent authority, contrary to the Article 21 and Article 243 (q) and (w) of the Constitution of India, contrary to the provisions of G.O.Ms.No.72, MA & UD (J1) Department, dated 20.02.2002 and contrary to the ratio decided by the Hon'ble Supreme Court of India and the Hon'ble High Court and consequentially direct the respondents to forbear and refrain from converting the park area for any other purpose or proceeding with construction of the proposed press club building and to pass such other order or further orders as the Hon'ble Court may deem fit and proper in the circumstances of the case."
Learned Government Pleader appearing for respondent Nos.1
and 2 submits that the proposal sent by respondent No.3 to respondent No.1 for conversion of park area into a Press Club, as stated in the prayer clause, has not been considered by the Government and now the Government do not propose to consider the same. In view thereof, nothing further survives in the writ petition. Writ petition is disposed of as infructuous. It is made clear that if at all the State Government takes any steps for conversion of park area to either Press Club or for any other purpose, it is open to the petitioner to take appropriate remedy against any such action. Consequently, miscellaneous petitions, if any, also stand disposed of. There shall be no order as to costs. _________________________ DILIP B. BHOSALE, ACJ ________________________ S.V.
