THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.12177 of 2015 ORDER:

This writ petition was filed challenging the proceedings of the first respondent dated 13.04.2015 in R.C. No.192/2015-D under Section 34-A(3) of the A.P. Cooperative Societies Act, 1964 proposing to hold a meeting for consideration of No Confidence Motion against the petitioners.

This Court while admitting the writ petition on 01.05.2015 observed that any resolution passed pursuant to the No Confidence Motion shall be subject to result of the writ petition. It appears that after admission of the writ petition the meeting for consideration of No Confidence Motion went on and the Motion was carried out. In view of the pendency of the writ petition, learned counsel for the petitioners seeks permission to withdraw the writ petition with liberty to challenge the resolution carrying out the motion of No Confidence in an appropriate Forum.

Permission is accorded.

Accordingly, this Writ Petition is dismissed as withdrawn giving liberty to the petitioners to challenge the resolution carrying out the motion of No Confidence in an appropriate Forum within a period of fifteen (15) days from today. No order as to costs. Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
