THE HONOURABLE SRI JUSTICE RAJA ELANGO CRL.P.M.P. No.3164 of 2015 and CRIMINAL PETITION No.1482 of 2015 ORDER:

This Criminal Petition is filed by the petitioner-accused No.2, under Section 482 Cr.P.C., seeking to quash the proceedings against him in PRC No.60 of 2010 on the file of the Judicial Magistrate of First Class, Sathupalli, Khammam District.

The offences alleged against the petitioner are punishable under Sections 336, 366 and 509 r/w.34 IPC.

When this matter has been taken up, the petitioners and the 2nd respondent, who appeared before this Court, submitted through their Counsel that due to intervention of the elders, they entered into compromise and therefore, the proceedings against the petitioner in the above case may be quashed. The 2nd respondent filed an affidavit to the effect that she has no objection to quash the proceedings in the above case against the petitioner, in view of the compromise. Both the parties have filed a joint memo also.

Learned counsel for the petitioner submitted that the proceedings against Accused No.1 in the above case were quashed by this Court in Crl.P. No.12390 of 2013 vide order, dated 17.12.2013, in view of the compromise and the petitioner herein also stands on the same footing and hence, the same benefit may be extended to him also. Learned counsel has produced a Photostat copy of the order passed in Crl.P. No.12390 of 2013.

In the above circumstances and in view of the compromise arrived at between the parties, this Court feels that it is just and proper to quash the proceedings against the petitioner. Hence, the above

Crl.M.P. is ordered, and the proceedings against the petitionerAccused No.2 in PRC No.60 of 2010 on the file of Judicial Magistrate of First Class, Sathupally, are hereby quashed. Accordingly, the Criminal Petition is allowed. Miscellaneous petitions pending, if any, shall stand closed. _______________ RAJA ELANGO, J April 01, 2016.
