HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION NO. 1601 OF 2015 ORDER:

On hearing both sides at the stage of admission, the following order is passed.

It is the submission of learned counsel for petitioner that the entire dispute is relating to a civil matter inasmuch as the accused filed O.S.No. 16 of 2012 on the file of Judge Family Court-cum-Additional District Judge at Karimnagar, against the complainant and others for specific performance of agreement of sale dated 13.5.2011 and the said suit is pending and the complainant lodged a false report with the police as if the accused forged the signatures of complainant and her mother and whether the said allegations are true or not has to be decided in a civil suit, and hence, the criminal proceedings may be quashed.

It is seen that the investigation is in progress and as such it is not a fit case to quash the proceedings. However, having regard to the fact that already civil disputes are pending between the parties, the Police of Basanth Nagar Police Station, Karimnagar District, are directed not to arrest the petitioner/accused during the course of investigation. The petitioner/accused shall cooperate with the investigating agency for smooth completion of investigation.

Accordingly, the Criminal Petition is disposed of.

As a sequel thereto, miscellaneous petitions, pending if any, shall stand closed.
