THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE GUDI SEVA SHYAM PRASAD WRI T PETI TI ON No. 13529 of 2016 ORDER: (per Hon'ble Sri Justice Sanjay Kumar) Sri V. Hanumanth Rao, learned counsel for the petitioner, states that the cause in this writ petition does not survive as Crl.M.P.No.324 of 2016 filed by Punjab and Sind Bank, the first respondent herein, before the learned Chief Metropolitan Magistrate, Cyberabad, L.B. Nagar, Ranga Reddy District, which is the subject matter of this writ petition, was abandoned thereafter and the Bank filed a fresh Criminal Miscellaneous Petition.

Sri S. Sainathan, learned standing counsel for the first respondent Bank, also concedes this.

In the light of the abandonment of the Criminal Miscellaneous Petition, which is subjected to challenge in this writ petition, we are of the opinion that no cause survives for independent adjudication presently. The writ petition is accordingly dismissed leaving it open to the petitioner to seek redressal of his grievance, if any, as regards the second Criminal Miscellaneous Petition filed by the Bank. Pending Miscellaneous Petitions shall also stand dismissed.
