THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.29099 of 2011 ORDER:

This writ petition is filed seeking the following relief: " This Hon'ble Court may be pleased to issue an order or direction more particularly one in the nature of Writ of " Mandamus"

declaring the action of the respondents herein in not providing alternate employment like Record Tracer/ ADC/ Booking Clerk/ Announcer to the petitioner in spite of his repeated requests though he was medically unfit as illegal, contrary to the provisions of Section 47 of the persons with disabilities (Equal Opportunities Protection of Rights and Full Participation) Act 1995, unjust and arbitrary and as such liable to be set aside with a consequential direction to pay the wages from 25.8.2008 to till reinstatement forthwith in the interest of justice and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstance of the case."

It is informed by the learned counsel for the petitioner that the petitioner was provided with alternative appointment. Considering the submission made by the learned counsel for the petitioner, it is needless to say that if the petitioner has got any grievance, it is left open to him to submit a representation seeking due wages for the period he was out of employment within two weeks from the date of receipt of a copy of this order and the respondents shall consider such representation and pass appropriate orders in accordance with law within a period of four weeks thereafter.
