HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.10104 OF 2017 ORDER:

This writ petition is filed challenging the proceedings No.B/798/2017 dated 04.03.2017 issued by the 3rd respondent wherein the application of the petitioner for grant of pattdar passbooks and title deeds is rejected on the ground that the petitioners entered into agreement of sale cum GPA in favour of 3rd parties.

Learned counsel for the petitioners submits that petitioners dispute the execution of agreement of sale in favour of 3rd parties and states that the 3rd respondent passed the impugned order without considering said aspects and without issuing notice.

A reading of the impugned order goes to show that 3rd respondent passed impugned order without notice to the petitioners and without considering the above said aspects. In view of the same, the impugned order dated 04.03.2017 is set aside and the 3rd respondent is directed to reconsider the application of the petitioners after giving notice to the petitioners as well as affected parties if any. The said exercise shall be done within a period of four (04) weeks from the date of receipt of copy of this order.

With the above direction, the writ petition is disposed of. No costs.
