HON'BLE DR. JUSTICE B. SIVA SANKARA RAO WRIT PETITION No.20059 of 2017 ORDER:

Heard learned counsel for the petitioner and also the learned Government Pleader for Civil Supplies representing the respondents and perused the prayer in the writ petition with the supporting affidavit and other material on record including the impugned order dated 07.10.2015.

It is the submission of the learned Government Pleader that no final order passed because of transfer of officers and the officer concerned i.e., 3rd respondent now recently resumed office and he is going to pass the order soon. However, the settled legal position right from 1996 of this Court is the order generally shall not exceed three months of interim suspension if at all for an exceptional case made out for special circumstances. Here in the case on hand there is nothing therein to continue the orders since 07.10.2015 and the same is liable to be set aside. Accordingly and in the result, the Writ Petition is disposed of and the order of suspension is set aside forthwith and the respondents are directed to pass final orders on own merits and any further grievance thereafter is left open. However to facilitate them to pass final orders, the petitioner shall appear before them on 03.07.2017 and appear on the other dates to be fixed. Consequently, miscellaneous petitions, if any shall stand closed. No costs.
