THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 6538 of 2022 ORDER:
This Criminal Petition is filed under Section 438 of Cr.P.C. by petitioner/A2 to A4 seeking bail in the event of their arrest in connection with Crime No.65 of 2022 on the file of Renjal Police Station, Nizamabad District, registered for the offences punishable under Section 307 read with 34 of Indian Penal Code. 2.
Heard learned counsel for the petitioners and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The case of the defacto complainant is that he had given an amount of Rs.1.4 lakhs to Accused No.1. In the said transaction when the amount was asked to be repaid, the said Accused No.1 entered into an altercation with the defacto complainant on 01.06.2022. On the very same day around 9.30 A.M. when he was sitting in the hotel, Acused No.1 along with these petitioners who are related to A1 went to the hotel and there A1 took out a knife and tried to stab the defacto complainant and he was stopped by the other persons nearby. In the said circumstances, the police on the basis of the complaint registered case under Section 307 read with 34 of IPC.

Learned Counsel for the petitioner submits that even according to complaint, it was A1 who had made an attempt to stab the defacto complainant. However, no injuries were received by the defacto complainant at the instance of A1. He also prayed for grant of Anticipatory Bail to these petitioners who are closely related to A1 and had accompanied the A1 without having any knowledge about any such attach by A1.

Learned Assistant Public Prosecutor on instructions submits that there are no injuries on the defacto complainant and that there are also no questionable antecedents against the petitioners. 6.
In the said circumstances these petitioners who are relatives of Accused No.1 can be granted the relief of Anticipatory Bail in the event of their arrest, subject to the following conditions:
1) The petitioners/A2 to A4 are directed to surrender before the Station House Officer, Renjal Police Station, Nizamabad District, within a period of ten days from the date of this order. On such surrender, the said Station House Officer, shall release the petitioners/A2 to A4 on bail, on their executing personal bonds for a sum of Rs.50,000/- (Rupees Fifty Thousand only) each with two sureties for a like sum each to his satisfaction.
2) On such release, the petitioners/A2 to A4 shall appear before the police every day between 10.00 a.m. to 1.00
p.m. for a period of three weeks, for the purpose of investigation.
3) The petitioners/A2 to A4 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.
Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
