THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.7663 OF 2016 ORDER:
This petition is filed by the petitioner-A2 under Section 438 Cr.P.C. seeking to grant anticipatory bail in Crime No.38 of 2016 on the file of Kandukur Town Police Station, Prakasam District, for the offence punishable under Sections 420, 323 r/w 34 IPC and Section 3 (1)(x)(s) and 3(2)(va) of SCs & STs (POA) Amendment Act, 2015. It is alleged that the petitioner and other accused took the loan amount sanctioned to Sthri Nidhi group members under the Government Scheme and when the members asked the accused to remit the loan amount, they did not remit the same and the accused picked up a quarrel with the group members and abused them in the name of their caste.
Learned Counsel for the petitioner submitted that the nature of the duty of the petitioner is to obtain the relevant documents, bank pass books and to submit the same to the bank so as to process the loan and that the loan amounts will directly be deposited into the accounts of DWACRA group and that the financial aspects were not entrusted to the petitioner and that the petitioner never committed the offence alleged.
The learned Additional Public Prosecutor opposed this petition and submitted that in view of the nature of the offence, this petition for anticipatory bail is not maintainable.
Considering the facts and circumstances of the case and the submissions made by the learned Additional Public Prosecutor and in view of the nature of the offence, this Court is of the view that this petition is not maintainable.
