HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No.46901 of 2016 Order:

This Writ Petition was filed challenging the action of the fourth respondent in issuing tender notification in Rc.No.plg/NH/Hyd/2016 dated 21.12.2016 calling for tenders to run the Diet Canteen for supply of diet to inpatients and duty doctors in Niloufer Hospital, Hyderabad. Learned counsel for the petitioner pointed out that the tender notification can be issued only by the District Diet Management Committee constituted under G.O.Ms.No.325, Health, Medical and Family Welfare (M1) Department, dated 01.11.2011, and the present notification was issued contrary to the State Government Order.

Though the learned Government Pleader produced before this Court a note orders of the Chairman of the committee for issuing the notification, since there was no decision of the District Diet Management Committee, this Court was not satisfied with the said orders and, in those circumstances, the learned Government Pleader, after obtaining necessary instructions, submits that the present tender notification would be withdrawn and fresh tender notification would be issued after obtaining proper decision of the District Diet Management Committee. In the circumstances, recording the statement of the learned Government Pleader, the Writ Petition is allowed. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
