THE HONOURABLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.36724 of 2014 ORDER:

Heard learned counsel for the petitioner as well as learned Government Pleader appearing for respondent Nos.1 to 4. 2.

The prayer sought in the writ petition is as under:- "...to issue an appropriate Writ, order or direction, more particularly one in the nature of Writ of Mandamus declaring the Respondent No.2 to 3 in interfering with the personal day to day life of the petitioner and his family members as is illegal, arbitrary and against the principles of natural justice, and violative of Article 14 and 21 of the Constitution of India without Jurisdiction, consequently direct the respondent to stop to visit the House of the petitioner and pass such other order or orders as this Hon'ble Court may deems fit and proper in the circumstances of the case." 3.

Learned Government Pleader placed on record the written instructions issued by the Station House Officer, Machareddy Police Station, Nizamabad District.

From a perusal of the said written instructions, it is revealed that there is a financial dispute between the petitioner and respondent Nos.5 to 7. It is mentioned in the instructions that respondent No.2 is transferred from the Station House Officer, Machareddy Police Station. The legal notice discloses that it was issued to Mr.Prasad only in his personal capacity. Respondent Nos.3 and 4 did not summon the petitioner at any point of time. As on the date of filing of the written instructions, the respondents have not interfered with the personal life and liberty of the petitioner and his family members. It is further mentioned in the written instructions that no crime was registered against the petitioner or his family members.

In that view of the matter, this Court is of the opinion that there are no merits in the writ petition and the same is liable to be closed. 6.
