THE HONOURABLE DR. JUSTICE D.NAGARJUN CRIMINAL REVISION CASE No.972 of 2009 O R D E R:

This Criminal Revision Case is filed by the petitioner under Section 397 and 401 of the Criminal Procedure Code, 1973, aggrieved by the Judgment dated 07.02.2008 passed by the learned III Additional District & Sessions Judge (FTC), Gadwal, confirming the Judgment of conviction and sentence passed in C.C.No.54 of 2003 by the learned Judicial First Class Magistrate, Gadwal.

Learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State / Respondent are present.

When the matter has been taken up for hearing, the learned Additional Public Prosecutor for the State / Respondent has submitted a letter stating that the petitioner in this matter is no more and filed death certificate to that effect.

In view of the above submission, this Criminal Revision Case is liable to be dismissed as abated. 05.

Accordingly, this Criminal Revision Case is dismissed as abated. There is no order as to costs. As a sequel, pending Miscellaneous Applications, if any, shall stand closed.
