THE HON'BLE SRI JUSTICE SANJAY KUMAR AND THE HON'BLE SRI JUSTICE M. SEETHARAMA MURTI WRIT PETITION Nos.1718, 1723, 1730, 1757, 1779 & 11364 of 2016 COMMON ORDER: (per Hon'ble Sri Justice Sanjay Kumar) This batch of cases arise out of the individual orders passed by the Central Administrative Tribunal, Hyderabad, in original applications filed by the unofficial respondents herein aggrieved by the manner in which the Bharat Sanchar Nigam Limited (BSNL) had conducted the Limited Internal Competitive Examinations for promotion to the grade of Junior Telecom Officer (Telephones). By the orders under challenge, the Tribunal directed the BSNL to re-evaluate all the answer sheets of the applicants based on the recommendations of an Expert Committee and work out the marks to be awarded to them afresh so that it can prepare a fresh list of qualified candidates. A further direction was given to the BSNL that if the applicants thereupon fell within the zone of consideration for promotion, they should also be promoted with all consequential benefits.

Sri B. Narasimha Sarma, learned counsel for the BSNL, placed before us a communication issued by the Assistant General Manager (Recruitment-II) of the BSNL through its Recruitment Branch at New Delhi addressed to all the Chief General Managers, Telecom Circles and others, revising the procedure to be followed for the Limited Internal Competitive Examinations, 2013, with which we are concerned. The learned counsel would state that in the light of the new procedure which has to be implemented in terms of the above communication, it is not necessary to give effect to the orders passed by the Tribunal.

Sri P. Suresh Reddy, learned Senior Counsel appearing for all the unofficial respondents in this batch of cases, would concede that in

the light of the new guidelines now issued by the Recruitment Branch of the BSNL, the grievance of the unofficial respondents may stand settled after the revision exercise is taken up in terms thereof. In that view of the matter, the orders under challenge in these writ petitions are set aside and the BSNL is directed to give effect to the revised procedure to be followed by the Expert Committee in respect of the Limited Internal Competitive Examinations, 2013, as per the communication dated 08.04.2016 and addendum dated 24.05.2016. This exercise shall be completed expeditiously and in any event, not later than three months from today. The writ petitions are allowed to the extent indicated above. Pending miscellaneous petitions, if any, shall stand disposed of in the light of this final order. No order as to costs. __________________________ SANJAY KUMAR, J ___________________________ M.
