THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.8335 OF 2023 ORDER:
This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioners/A1 & A2, in Crime No.121 of 2023 on the file of Khanapur Police Station, Nirmal District, registered for the offences punishable under Section 307 r/w.34 of the Indian Penal Code.

Heard learned counsel for the petitioners and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The defacto complainant lodged a complaint stating that these petitioners along with 6 others went to the house of the defacto complainant and questioned about one D.Srikanth who is the son of 2nd petitioner herein. Then the defacto complainant replied that he had not come, for which reason all the accused attacked the defacto complainant. There after the son of the defacto complainant and father of the defacto complainant were also attacked.

Learned Counsel appearing for the petitioners would submit that the defacto complainant's niece was married to D.Srikanth and there were difference between the spouses, for which reason the incident occurred.

Learned Assistant Public Prosecutor on instructions would submit that the injured have been treated and now they discharged from the hospital.

Keeping in view that the altercation is the result of family disputes, this Court deems it appropriate to grant the relief of Regular Bail to the petitioners subject to the following conditions:
i) The petitioners/A1 & A2 shall execute personal bonds for a sum of Rs.20,000/- (Rupees Twenty Thousand only) each with two sureties for a like sum each to the satisfaction of Judicial First Class Magistrate at Khanapur.
ii) The petitioners/A1 & A2, after release, shall appear before the concerned Station House Officer every Monday between 10.30 AM and 01.00 PM., for a period of eight weeks or till filing of charge sheet, whichever is earlier, for the purpose of investigation.
iii) The petitioners/A1 & A2 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C. 7.
Accordingly, the criminal petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
