THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.11899 of 2016 ORDER:
Heard the learned counsel for the petitioners and the learned Government Pleader for Revenue appearing for the respondents.
2. Petitioners' grievance is that respondent No.3 is interfering with their possession and enjoyment of land to an extent of Ac.0.15 cents in Sy.No.400/9B of Inkollu Village, Prakasam District, without following due process of law.
3. Learned Government Pleader for Revenue appearing for respondents states that respondent No.3 is not interfering with the possession and enjoyment of the said property and that the successors of the sister of petitioner No.1, by name late Subbaravamma, are in the possession of the subject property.
4. Therefore, without expressing any opinion as to whether the petitioners or the successors of Subbaravamma are in possession of the subject property, since respondent No.3 is stated to be not interfering with the subject land, the same is placed on record.
5. Accordingly, the Writ Petition is closed. No costs.
6. As a sequel, the miscellaneous petitions, if any pending, shall stand closed.
