HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.20252 OF 2018 O R D E R :

This writ petition is filed challenging the action of the respondent Nos.1 to 4 in proposing to vacate the petitioners from the property situated at House No.9-9-29, 9-9-30/A & B consisting of two buildings covered by 20,239 sq.ft in Survey No.1138 of Ramnagar, Karimnagar, contrary to the lease deed dated 01.06.2017.

Heard both sides.

Admittedly, there is agreement between petitioners and respondents and the petitioners filed the writ petition for enforcing the terms of the contract. This Court cannot go into the disputed questions of fact involved in this lis in the writ petition, that too arising out of contractual obligations between the parties. Petitioners have alternate remedy by approaching the Civil Court. In view of the same, I do not see any reason to entertain the writ petition.

Accordingly the writ petition is dismissed. However, it is open for the petitioners to avail alternate remedy as may be available to them under law. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
