A notification, dated 31.05.2018, issued by the 3rd respondent/ temple proposing to hold public auction for leasing out its lands is under challenge in this Writ Petition. The only ground urged in the present writ petition for impugning the impugned notification is a condition incorporated in the impugned notification asking the interested participants to furnish security of Rs.50,000/ - per acre.

According to the learned Counsel for the petitioners, the said condition is highly arbitrary, unreasonable and impracticable to comply that.

On the other hand, it is submitted by the learned Government Pleader so also Sri V.Satyanarayana Prasad, learned Standing Counsel for the 3rd respondent/ temple that there is no provision either under the Endowments Act, 1987 or under the Rules made there under nor there are any instructions of the State Government which enables the petitioner to claim exemption from such condition.

No instructions of the State Government are brought to the notice of this Court which enables the petitioners herein to have the benefit of exemption of payment from furnishing such security. In the absence of the same, this Court is not inclined to consider the request of the petitioners herein. The Writ Petition is accordingly dismissed. No order as to costs.

Miscellaneous Petitions pending consideration, if any, in this Writ Petition shall stand closed.
