THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.17928 OF 2017 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:- "to issue a writ, order or direction, more particularly one in the nature of Writ of Mandamus declaring the action of the 2nd respondent in passing impugned order of cancellation of licence of the petitioner in proceedings Rc.No.926/2011-F1, dt.19.04.2017 is illegal, arbitrary and in violation of principles of natural justice and consequently set aside the same."

Learned counsel for the petitioner submitted that even though the petitioner has submitted a representation on 30.03.2017 to respondent No.2, the same was not considered till date and the impugned order does not disclose any reference regarding the said representation and hence, requested the Court to direct respondent No.2 herein to consider the said representation and pass appropriate orders in accordance with law.

Considering the facts and circumstances of the case and the grievance of the petitioner, without going into the merits of the case, respondent No.2 is hereby directed to pass a fresh order in accordance with law on or before 20.07.2017 after taking into consideration the representation, dated 30.03.2017, of the petitioner. Till then, respondent No.2 is directed not to take any coercive steps against the petitioner.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
