HONOURABLE SRI JUSTICE A.RAMALINGESWARA RAO CONTEMPT CASE No.1736 of 2015 ORDER:

This Contempt Case is filed alleging non-implementation of the order passed by this Court in W.P.No.19890 of 2008 dated 20.10.2014.

The aforesaid Writ Petition was filed by the petitioner herein challenging the unauthorized construction made in the parking area by respondents 3 to 6 therein and the inaction of respondents 1 and 2 in demolishing the same. This Court by order dated 20.10.2014 closed the said writ petition by recording the statement made by the learned Standing Counsel for the Municipality with regard to the action to be taken in respect of the construction made in the parking area, which could not regularized.

Now, an affidavit is filed by the Commissioner, Bhimavaram Municipality stating that an understanding was arrived at by the petitioner and the unofficial respondents in the Writ Petition and the petitioner in the writ petition does not want to pursue the case and he wanted to withdraw the Contempt Case. In those circumstances, he deferred the further action.

In view of the disinterest shown by the petitioner in pursuing the case and implementation of the order in W.P.No.19890 of 2008 dated 20.10.2014, the further proceedings in the Contempt Case are dropped.
