THE HON'BLE SRI JUSTICE T. SUNIL CHOWDARY CIVIL MISCELLANEOUS APPEAL No.787 OF 2016 ORDER:

This Civil Miscellaneous Appeal, under Order 43 Rule 1 CPC, is filed challenging the order dated 23.05.2016 passed in I.A.No.806 of 2016 in O.S.No.333 of 2016 on the file of the Court of the 24th Additional Chief Judge, City Civil Court, Hyderabad.

At the time of hearing, the learned counsel for both parties submitted that the trial Court heard the matter and that the I.A is coming up for orders.

In view of the submissions made by the learned counsel for both the parties, this Court is not inclined to go into the merits of the main case. Having regard to the facts and circumstances of the case and in view of the submissions made by both counsel, the learned 24th Additional Chief Judge, City Civil Court, Hyderabad is hereby directed to dispose of I.A.No.806 of 2016 in O.S.No.333 of 2016 as expeditiously as possible, preferably, on or before 6th June, 2017.

This Civil Miscellaneous Appeal is accordingly disposed of. As a sequel, the miscellaneous petitions, pending in this Civil Miscellaneous Appeal, if any, shall stand closed.
