HON'BLE SRI JUSTICE U.DURGA PRASAD RAO WRIT PETITION No.27142 OF 2008 ORDER:

The petitioner seeks writ of mandamus declaring the action of the respondent Bank in depriving the petitioner of benefit of Agricultural Debt Waiver and Debt Relief scheme, 2008 to the agricultural loan availed by the petitioner, vide Account No.21/2007 in the 3rd respondent Bank as illegal, arbitrary and contrary to the Agricultural Debt Waiver And Debt Relief Scheme, 2008 and direct the respondents to extend such benefit under the scheme to the petitioner.

When the matter came up for hearing, learned counsel for petitioner would submit that, as per his information, the petitioner has paid the loan and redeemed his gold pledged with the bank. 3.

In view of the above submission, it is clear that the loan account of the petitioner is closed with the bank and therefore, the question of considering his case for extension of benefit of the Agricultural Debt Waiver And Debt Relief Scheme 2008, at this stage, does not arise. Therefore, the cause in the writ petition has become infructuous.

Accordingly, this writ petition is dismissed as infructuous. As a sequel, miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
